Terms and Conditions

The information below tells you how you may use the website www.sjpclientcommunity.co.uk (referred to as the “Site”) and how you may participate in the St. James’s Place Client Community (referred to as “Community”) and the Partner Consultation programme (referred to as “Consultation programme”). Please read these terms and conditions (the "Terms") carefully before using the Site and participating in the Community or Consultation programme

By using the Site and by registering as a member of the Community or Consultation programme, you agree to be legally bound by the version of these Terms in force at that time. If you do not agree with any of our Terms, then you should not register or use our Site.

Please note that we may update and amend these Terms from time to time and the current version of these terms will be posted on the Site. It is your responsibility to ensure you review these Terms regularly to familiarise yourself with any changes. Your use of the Site and participation in the Community or Consultation programme following any such changes will constitute your acceptance of the revised Terms.

Who operates and who owns the Site, the Community and Consultation programme?

The Community, Consultation programme and the Site are administered and managed jointly by The Wisdom Council and STRAT7 Researchbods, a division of STRAT7 Limited (Researchbods).

The Wisdom Council is a trading name of Wisdom Global Limited a company registered in England under company number 08589400 whose registered office is Cannon Green, 27 Bush Lane, London EC4R 0AA.

Researchbods is a company registered in England under company number 07642707 whose registered office is at 11 Soho Street, London, W1D 3AD, United Kingdom.

Reference to “we, us, or our” are jointly references to The Wisdom Council and Researchbods together.

We administer and manage the Community, Consultation programme and the Site on behalf of St. James’s Place Wealth Management plc a company registered in England under company number 04113955 whose registered office is at St. James’s Place House, 1 Tetbury Road, Cirencester, GL7 1FP (“St. James’s Place”) St. James’s Place owns all rights and interests in the Community, Consultation programme and the Site.

References to "you" or "your" mean you as a member of the Community or Consultation programme, and user of the Site.

Who can register as a member?

Membership in the Community is free and is open to individuals who are clients of St. James’s Place only (not corporations or other business entities).

Membership in the Consultation programme is free and open to individuals who are Adviser or Partners of St. James’s Place only (not corporations or other business entities).

Only one registration per person is permitted.

You must be over 18 years of age to join.

How do you register as a member?

In order to register as a member, you will be asked to provide your name (forename and surname), your personal email address and your date of birth. You promise that all information and details provided are true, accurate and up to date in all respects and at all times.

You will also be asked to create a unique user name and password. You are responsible for all activity that occurs under your user name and password. You must keep your password confidential and you must not disclose it to any third party. We will not be responsible where your password is used by someone else. You should notify us immediately of any unauthorised use of your user name or password and any breach of security as soon as you become aware of it. We have the right to disable any user name or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

How do we use your information?

Please read our Privacy Notice and our Cookies Notice posted on this Site, which contain important information about how we use any personal information about you that we receive through your registration and participation in the Community or Consultation programme, and use of the Site. By using the Site and registering as a member of the Community or Consultation programme, you also acknowledge and agree that we may disclose any personal information you provide to St. James’s Place.

If there is any inconsistency between these Terms and the terms of our Privacy Notice and Cookies Notice, the Privacy Notice and Cookies Notice will prevail to the extent of such inconsistency.

How do we communicate with you?

To manage and administer the Community, Consultation programme and the Site and to allow us to fulfil our obligations to you under these Terms, we may communicate with you by email or by posting notices on the Site. You agree to receive communications from us electronically in this way, and that electronic communications will satisfy any legal requirement for communications to be in writing.

Are there any restrictions when using the Site or participating in the Community or Consultation programme?

You further agree that you will not:

  • use the Site to in any way infringe the privacy or other rights of any other person;
  • use the Site in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm or inconvenience to any other person;
  • do anything that subjects the Site, Community, Consultation programme, St. James’s Place or us to any derogatory treatment or brings (or might bring) the Site, Community, Consultation programme, St. James’s Place or us into disrepute;
  • do anything that may cause damage to the Site or our servers, systems or equipment or those of third parties, nor access or attempt to access any users' data;
  • misuse or do anything that disrupts all or any part of the Site, including but not limited to knowingly introducing software viruses, trojans, worms or other material that may be technologically harmful; and
  • penetrate, remove or otherwise alter or interfere with any security measures that we use to protect the material and content made available via our Site, or attempt to do so or assist any other person in doing or attempting to do so.

You agree to compensate us in respect of any damages or losses suffered by us as a result of any claim made by a third party relating to (a) your use of the Site in breach of these Terms (or any other applicable terms), or (b) your violation of any applicable law or regulation when using the Site.

You promise to us that you are authorised to agree to these Terms and any other terms that apply to the use of our Site (including but not limited to our Privacy Notice and Cookie Notice and/or any specific usage rules that may be posted in relation to any content or material that you access via the Site, Community, Consultation programme and/or any third party terms).

Who is responsible for user generated content?

The Site may incorporate certain content that is generated by members (including you) ("User Generated Content"). You acknowledge and agree that:

  • our ability to control the User Generated Content is limited;
  • we do not endorse User Generated Content and cannot guarantee that it will meet the standards that content produced by us would ordinarily meet; and
  • any views expressed in User Generated Content do not necessarily reflect our views.
  • Consequently, we do not accept any responsibility or liability for User Generated Content or any actions or omissions that you may take in reliance on it.

What additional terms apply to content you submit?

If you wish to submit any contribution to the Site or upload any content such as any text (including, for instance, on any chat rooms or forums or on any classified pages), photographs, graphics, video or audio to the Site ("Submission"), you agree that any Submission you make must not contain:

  • anything that may have the effect of being harassing, threatening, abusive or hateful or which degrades, discriminates against or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or any other legally protected characteristic;
  • anything that infringes the rights of a third party;
  • any third party content such as music, third party trademarks, logos, location signage, or photographs, artwork or sculpture unless you have consent from the owner to include that third party content; or
  • anything that is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or that would constitute a contempt of court or expose us to any civil or criminal proceedings.

By making a Submission, you grant us a royalty-free, perpetual, irrevocable, non-exclusive worldwide license to use, copy, edit, adapt, publish, translate, create derivative works from, make available, communicate and distribute that material (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed. To the extent permitted by law, you waive your moral rights (e.g. the right to be identified as author or to object to derogatory treatment) in any Submission you make.

You further agree that you will not endanger yourself or others, or take any unnecessary risks in order to produce or make your Submission.

How can your membership be terminated?

You may terminate your membership at any time by unsubscribing from the Community or Consultation programme. This can be done by going directly to your ‘Profile’ page. Here you can update your membership information or delete your account entirely. Alternatively, you can send your unsubscribe request to us at support@sjpclientcommunity.co.uk (for Community members) or partnersupport@sjpclientcommunity.co.uk (for Consultation programme members).

If you unsubscribe from your membership, your profile information will be removed, you will be unable to access the Site and you will no longer receive emails from us. In addition, Community members will forfeit any incentives or rewards that have not been administered at the time you opt out.

The termination will take effect up as soon as reasonably practicable following receipt of the unsubscribe notice, and in any event within 5 business days thereafter.

We may close the Community or Consultation programme when the research programme ends or is cancelled. We will inform all members by email of the Community or Consultation programme being closed, at which point your access to it will cease.

We also reserve the right to suspend or terminate your membership, or your ability to access to the Site immediately and without notice at any time, at our sole and absolute discretion. This may be because, for example, we consider that you have breached these Terms or any other applicable terms.

What are our obligations and limits on liability?

The Site, Community and Consultation programme are provided on an 'as is' and 'as available' basis. We cannot promise that the Community, Consultation programme or Site will be free from errors or omissions, nor that they will be available uninterrupted and in a fully operating condition, or free from viruses or other harmful components. We make no guarantee that all or any features of the Site, Community or Consultation programme will work on any particular device.

Any content or other materials included in the Site do not, and are not intended to, amount to advice on which you should rely. Consequently, we do not accept any responsibility or liability for any actions or omissions that you may take in reliance on such content or materials.

By using the Site and participating in the Community or Consultation programme, you agree to release St. James’s Place from any and all liability whatsoever arising in any way from your use, misuse or inability to use the Site, Community or Consultation programme.

To the maximum extent permitted by law, neither we nor St. James’s Place will be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use, misuse, or inability to use the Site or participation in the Community or Consultation programme, including without limitation, any direct, indirect, incidental, special or consequential damages, expenses or losses of whatever nature, including damage to software or hardware, loss of data, damage for loss of business, loss of profits, or any other indirect or consequential loss.

Nothing in these Terms will:

  • restrict your statutory rights as a consumer (including your rights to receive a reasonable standard of service, more details about which can be obtained from your local Trading Standards Office or Citizen's Advice Bureau); or
  • limit our liability for death or personal injury resulting from our negligence or our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or other liability which cannot be excluded or limited under applicable law.

Who can use the intellectual property in the Site?

Nothing contained in these Terms grants you a license or a right to use any copyright, trademarks, design rights, patents or other intellectual property right owned or controlled by us, companies in the St. James’s Place group, our respective partners or any third party, except to the limited extent necessary to access and use the Site, Community and Consultation programme.

Can a third party enforce these Terms?

These terms do not create any rights that are enforceable by any person who is not a party to these Terms, with the exception of St. James’s Place who may enforce these Terms as if it was a party thereto.

What happens if we do not enforce a right under these Terms against you?

If we decide not to exercise or enforce a right that we have against you (e.g. as a result of you breaching these Terms), this does not prevent us from doing so at a later date.

What happens if part of these Terms is not enforceable?

If any provision of these Terms is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable then that invalid or unenforceable part will be deemed deleted from these Terms, such invalidity or unenforceability will not affect the other provisions of these Terms and they will remain in full force and effect.

What happens if there is a dispute about these Terms?

These Terms are available in English only and are governed by and construed in accordance with the laws of England and Wales. Disputes arising in connection with these Terms are subject to the exclusive jurisdiction of the courts of England and Wales.

How do you report potential abuse?

Any member can report an abusive comment using the ‘Report’ button on the Site. The ‘Report’ button is positioned next to every individual comment made by every individual member. Members can also report abuse directly by sending an email to support@sjpclientcommunity.co.uk (for Community members) or partnersupport@sjpclientcommunity.co.uk (for Consultation programme members).
